Information on Amendments to the NESHAP for Hazardous Waste Combustors Available

On June 18, 2008, the DOE Office of Environmental Policy and Assistance (HS-22) issued an Environmental Information Notice entitled, Environmental Protection Agency Final Clean Air Act Rule: Amendments to the NESHAP for Hazardous Waste Combustors, which summarizes an April 8, 2008, EPA final rule (73 FR 18970) that amends the National Emission Standards for Hazardous Air Pollutants (NESHAP) for hazardous waste combustors at 40 CFR 63, Subpart EEE. The amendments clarify several compliance and monitoring provisions in Subpart EEE and also correct several omissions and typographical errors in the October 12, 2005, final rule. The final rule does not change the October 14, 2008, compliance date established by the October 12, 2005, final rule. What’s New in DOE Order 450.1A?

On June 4, 2008, the Deputy Secretary approved DOE Order 450.1A, Environmental Protection Program. This Order revises the previous DOE O 450.1 (issued in January 2003) to incorporate the new requirements of Executive Order 13423, Strengthening Federal Environmental, Energy, and Transportation Management (issued in January 2007), and Instructions for Implementing E.O. 13423 (issued by the Council on Environmental Quality in March 2007). DOE O 450.1A contains requirements to:

  • implement sustainable practices (addressed in DOE O 450.1A and DOE O 430.2B, Departmental Energy, Renewable Energy and Transportation);
  • have EMSs that "reflect the EMS elements and framework found in ISO 14001:2004";
  • include in EMSs specified compliance management elements such as an environmental compliance audit program;
  • conduct a "formal audit by a qualified party outside the control or scope of the EMS" before declaration of initial implementation and every three years thereafter; and
  • have DOE managers declare DOE EMSs in conformance with new requirements by June 30, 2009.

DOE Presentations on Achieving the High Performance Sustainable Building Goals Available

In June 2008 the DOE Office of Environmental Policy and Assistance (HS-22) made several presentations at the Federal Environmental Symposia East & West. The HS-22 presentation discussed tools and strategies for DOE to achieve the High Performance Sustainable Building goals, specifically the 15% of existing building inventory by 2015 goal of Executive Order 13423 and DOE 430.2B. Revised RESRAD Computer Codes Available

On February 8, 2008, the DOE Office of Environmental Policy and Assistance (HS-22) issued a Nuclear Safety and Environment Information Notice entitled, Release of RESRAD (V.6.4) and RESRAD-BUILD (V.3.4) Revised Codes: Tools for Evaluating Radiation Doses and Risks. RESRAD is a computer model code designed to estimate radiation doses and risks from RESidual RADioactive materials. This family of codes was developed by Argonne National Laboratory (ANL); however, code and version control are currently maintained by the Department of Energy through ANL. These codes now share the same radionuclide database and include International Commission on Radiological Protection (ICRP) 72 age-dependent dose conversion factors. This will result in consistency across RESRAD codes when multiple codes are used.

DOE Requests Information on Contacts for issues related to Control of Invasive Vegetation

On April 1, 2008, the DOE Office of Environmental Policy and Assistance (HS-22) issued a Nuclear Safety and Environment Information Notice entitled, National Invasive Species Council and the Federal Interagency Committee for the Management of Noxious and Exotic Weeds. The notice asks for the names of the persons who are currently involved in issues related to the control of invasive vegetation at DOE sites. DOE is responsible for the maintenance and protection of thousands of acres of property across the U.S. and is actively involved in all areas related to the environmental stewardship and ecological integrity of those lands. In order to determine whether control of invasive vegetation is a relevant issue to DOE sites, HS-22 is asking DOE organizations to provide the names of persons who are currently involved in issues related to the control of invasive vegetation and who could serve as contacts in relation to this issue. Information Brief on NAAQS Final Rule on Fine Particles (PM2.5) Available

On March 25, 2008, the DOE Office of Environmental Policy and Assistance (HS-22) issued an Information Brief entitled, Final Clean Air Act Fine Particle Implementation Rule (HS-20-IB-2008-08, 72 FR 20586). The Information Brief discusses an EPA final rule on the fine particle (PM2.5) National Ambient Air Quality Standard (NAAQS). The rule provides guidance and direction to State and Tribal agencies on the development and content of PM2.5 implementation plans. By April 5, 2008, each State having a PM2.5 nonattainment area must submit an implementation plan to EPA to ensure the area attains the NAAQS as expeditiously as possible, but no later than 2015. Managers of DOE sites located in PM2.5 nonattainment areas will need to ensure their operations comply with associated PM2.5 implementation plan requirements.
