RMP Documents

Under the Clean Air Act, EPA has adopted regulations to help prevent accidental releases of hazardous chemicals that have the potential to affect public health and the environment. On May 24, 1996, EPA issued regulations establishing risk management planning (RMP) requirements for facilities that handle, use, produce, or store acutely hazardous substances. These requirements are applicable to federal facilities, and risk management plans are required to be filed for covered installations on or before June 21, 1999.

The following documents may be of use to DOE staff in determining whether the RMP requirement apply:

• Chemical Safety Information, Site Security and Fuels Regulatory Relief Act, August 1999, 2 pp., 79,487 bytes. This is an EPA Fact Sheet that discusses the August 5, 1999, legislation signed by President Clinton that removes from coverage by the RMP program any flammable fuel when used as fuel or held for sale as fuel by a retail facility. The legislation also limits access to Off-Site Consequence Analysis (OCA) data that are reported in RMPs by covered facilities.
   
• The General Duty Clause, June 1999, 2 pp., 51,530 bytes. This is an EPA Fact Sheet that addresses Section 112(r)(1) of the Clean Air Act, also known as the General Duty Clause (GDC), which makes the owners and operators of facilities that have regulated and extremely hazardous substances responsible for ensuring that their chemicals are managed safely.
   
• Use Multiple Data Sources for Safer Emergency Response, June 1999, 6 pp., 51,631 bytes. This is an EPA Fact Sheet that is designed to increase awareness on the limitations of Material Safety Data Sheets (MSDSs) so that first responders to emergency situations can take proper precaution.
