Dear Mr. Whitaker:

 

In March 2004, Timothy Dwyer transmitted to the Department of Energy (DOE) a list of DOE Orders of Interest to the Defense Nuclear Facilities Safety Board (Board).  Since that time, a number of Orders have been revised, and pertinent new directives have been identified as a result of reviews by the Board’s staff.  In view of these changes, it is appropriate to update the list of Orders of Interest to the Board as indicated in the enclosed tables.

 

The format of the enclosed list is the same as the March 2004 list.  It consists of four groups:  (1) currently active orders; (2) a place holder for the pending National Nuclear Security Administration Directives system; (3) archived or deleted Orders that may still be cited in existing contracts; and (4) other documents setting forth safety-related requirements.

 

As noted in previous correspondence, the Board remains interested in all associated documents, such as Standards, handbooks, and other documents relevant to the identified Orders, since these documents clarify and expand upon the Orders.  In addition, the Board is interested in specific documents that are not necessarily associated with hierarchical orders, such as DOE-STD-3009-94 (Change Notice #2), Preparation Guide for U.S. DOE Nonreactor Nuclear Facility Safety Analysis Reports.

 

As also noted in previous correspondence, the Orders identified in the archived list are still of interest to the Board, even though some of these Orders have been, or may be, cancelled or superseded by new Orders or Rules.  The Board will continue to consider these to be Orders of Interest until all the contracts governing defense nuclear facilities that specify these Orders have been renegotiated, amended, or replaced by new contracts, resulting in appropriate incorporation of the new Orders.
