HSO SPOTLIGHT No. 004-2009: Reporting Drug Test Results for Contractors Applying for an Access Authorization (Security Clearance)

What is the issue: Results of tests for the presence of illegal drugs will be required for processing contractors for DOE Access Authorizations (Security Clearances)
Why do we need this?:  10 CFR 707, Workplace Substance Abuse Programs at DOE Sites; Acquisition Letter 2008-03, Rev. 1, issued by the Office of Procurement; and Secretary of Energy memorandum, dated September 14, 2007, establish requirements for drug testing for clearance applicants
Who is impacted?: Contractors requesting a DOE Security Clearance at HQ, their employers and HSOs
What does the HSO need to do?:  Assure that a copy of the results of a drug test is included with the paperwork submitted with clearance application packages
   
 

DOE is committed to maintaining a drug-free workplace. To that end, contractors applying for positions that require an access authorization (security clearance) must undergo and pass a drug test in accordance with Title 10, Code of Federal Regulations, Part 710, Workplace Substance Abuse Programs at DOE Sites (10 CFR 707).

In March 2008, the DOE Office of Procurement issued Acquisition Letter 2008-03, Rev.1, which instructed Contracting Officer's Representatives (CORs) to assure their organization's contractors conform to 10 CFR 707 requirements. Specifically, contracts were to be modified to require the contractor to drug test all of their employees applying for an initial access authorization and establish a process to randomly select employees with access authorizations for a drug test.

The Office of Headquarters Personnel Security Operations (HS-1.32) has allowed more than a year for these contract modifications to be made and is now ready to implement this requirement. Effective 30 days from the date of this HSO Spotlight, all new request packages for initial DOE access authorizations submitted to HS-1.32 for a contractor must include either a copy of the laboratory report showing the results of the contractor's drug test or a statement attesting to the date, location and results of the drug test that was conducted. Drug test results must be dated within 30 days of the date of the access authorization request. A new drug test will not be required for an applicant who already possesses a current access authorization from DOE or another federal agency, or whose access authorization may be reinstated without the need for a new federal background investigation pursuant to Executive Order 12968, Access to Classified Information, Sections 3.3 (c ) and (d).

Note that the drug testing requirement has already been fully implemented by the Office of Human Capital Management for DOE Federal employees; HSOs do not need to provide the drug testing results for these employees.

HSO Program Manager Comment: The Headquarters Facilities Master Security Plan is currently being updated.
